Yes, it would extinguish it for a buyer in foreclosure auction but they would retain a judgment against the prior owner

Depends whether you are referring to the lawyer that prepared the will or the one that is filing the probate. I would need additional info.

Unfortunately yes. Either joint tenants can cause additional mortgages on the property without the consent or knowledge of the other.
