I hired Mr. Daniel Shulefand for a criminal defense because I was arrested for two counts of battery on a law enforcement, officer and resisting with violence, disorderly intoxication, and trespassing. When I came to Mr. Shulefand my shoulder was broken and I had a black eye because the PBSO had used... excessive force and punched me in the face when I yelled at one of the officers. The whole incident was caught on the restaurant cameras in the lobby. I hired Mr. Shulefand on the basis that he secure that footage & he was adamant he could get the video. Which he never filed a motion to get the video evidence. When I asked him why he never put the motion in for the video surveillance of the arrest, he said he thought it would be in the discovery. If I was guilty of battery on a L.E.O. The video would be in the discovery to be used against me in trial. I paid him upfront 5 grand which was a huge mistake because he didn’t work on my case. At that point he was harder to get in touch with that a public defender by phone, email, or voicemail. I was very upset at the whole situation and fed up with everything. I did get arrested again for misdemeanor battery touch or strike when I flicked an Uber drivers ear, I was drinking. At that point my bond was revoked and Mr. Shulefand secured $2,500 without my permission from my elderly senior citizen parents. He knew I was unhappy with his service and wanted to bond out so I could find a new lawyer. He missed a court date for the misdemeanor and was 3 hrs late for the felony court. He kept trying to get me to take a plea deal, when I wanted the video of the arrest. He never even tried to get the video surveillance footage probably because once he had all his money he forgot all about me and went to work on other cases. He also does traffic court so he probably handle a ton of small court appearances. That was the whole reason I hired him because he made it sound like it would be no problem to get that key evidence into the discovery. However, once he had his money he did the absolute bare minimum. The state knew they had a weak case and offered me six months when I had been in for two. I turned down the the offer and argued with Nr. Shulefand in the court because till that point I was unable to get in touch with by phone or visit while incarcerated. He didn’t even know what I would or would’ve accepted as an offer because he never talked to me on the phone. I just kept getting his paralegal who kept putting me on hold during a paid/timed phone call. The State said I scored out to 30 months with the new charges and when he argued my bond reinstatement, He stood in front of the judge like and said well he scores out to 30 months like that was his closing argument. Well it turns out he was going by what the state was telling him and when they listed my past charges in open court half of them were not even my charges. He never checked my score sheet or knew what my past charges are. He didn’t really know if I scored out to 30 months. I went back the next month, which was my 3rd month being in jail and accepted the 6 month plea. Even the judge told him I completed probation and do better on that. It was just so many things he dropped the ball on my cases. I felt like a public defender could have done a better job and got better results. I took the six months because at that point I had three months in and with gain time could be home to my wife and kid in two. besides if I had turned down that 6 month offer again the state probably would have waited till I had six months in and offered credit time served. Which who’s not going to take that to go home. I felt Mr. Shulefand could of done a lot different like getting me house arrest or probation or less time if he wanted me to accept a plea but he already had his money and did what was best or most convenient for him. I would advise to find a different attorney or just go with a public defender rather than waist your money hiring Mr. Shulefand.
