Brian Dewitt Shank

Brian Shank is an associate attorney at Pearson Bitman LLP. He is a Florida Bar Board Certified in Construction Law, and has over a decade of experience representing large organizational clients from automobile and recreational vehicle manufacturers to global design consultancies, contractors, and suppliers. 

Brian’s experience ranges from automotive and recreational vehicle warranty, Lemon Law, and products liability litigation to construction, commercial, and insurance matters.  His practice focuses on the representation of design professionals in complex construction litigation in federal and state court, as well as in appeals and alternative dispute resolution processes.  He has represented design professionals in errors and omissions claims involving a broad spectrum of disciplines from roadway, stormwater, wastewater, structural, environmental, and geotechnical engineering to architecture and landscape architecture.   

Brian has also handled the defense of complex personal injury and wrongful death claims brought against design professionals relating to roadway design and maintenance of traffic issues, as well as in professional licensure proceedings.  Brian has represented architects and landscape architects in errors and omissions claims involving both horizontal and vertical construction.  Brian was heavily involved in defending a Fortune Top 100 engineering firm from design defect claims relating to a $325 million Florida airport project.  

Brian’s practice also has a special emphasis on the representation of multi-national mobile space and heavy equipment suppliers in construction, commercial, and collections litigation.  He is privileged to regularly support in-house legal departments advising on risk avoidance, and in reviewing, drafting, and negotiating contract documents for commercial transactions.
