Robert James Powell

Robert’s practice consists of commercial litigation, creditors’ rights, and bankruptcy matters. He has represented national, regional, and local financial institutions, private equity lenders, and credit unions in a variety of litigation matters including commercial loan enforcement, foreclosures, and related post-judgment collection matters. He has assisted his clients with commercial loan work-outs, as well as the resolution of lender-liability claims, fidelity bond claims, and various actions pursuant to the Uniform Commercial Code. Robert routinely defends the rights of his creditor clients in bankruptcy proceedings including secured and unsecured claim administration, debt reaffirmation, obtaining relief from the automatic stay, as well as challenges to exemptions, discharge, dischargeability, and the confirmation of reorganization plans. He has been engaged by bankruptcy trustees to recover property of the estate and has handled other contested matters and adversary proceedings including the avoidance of fraudulent and preferential transfers of assets.

Robert also maintains an active appellate practice. He successfully briefed and argued before the U.S. Court of Appeals for the Eleventh Circuit in just the second year of his practice. Robert has also briefed and argued before the Florida First District Court of Appeal involving a variety of practice areas including real property, probate, wrongful death, guardianship, and domestic matters. He has also successfully handled the appeal of a bankruptcy decision to the U.S. District Court for the Northern District of Florida.

Prior to entering the practice of law, Robert sold real estate and he still maintains an active Florida broker’s license.
