Obtained a defense verdict in a case alleging products liability and negligence against our client, a hotel management company. A hotel guest placed a towel in the microwave, which caught fire and mel ... ted the microwave, but did not create enough smoke to trigger the alarm. Plaintiff, a guest in the adjacent room, claimed she suffered permanent respiratory injuries from exposure to the toxic fumes. She argued that our client was negligent for not notifying her of the fire, thus prolonging her exposure to the fumes. Plaintiff's hospitality expert opined that this fell below the standard of care, and her pulmonology expert opined that her injuries were caused by the incident. The defense argued that it was not necessary to notify plaintiff given the small amount of smoke, that her respiratory injuries were preexisting, and that the other guest's negligence was the causal factor. Plaintiff asked the jury for $228,125. The jury found that defendant was negligent, but that its negligence was not a substantial factor in causing plaintiff's injuries, thus resulting in a defense verdict.
