if your HOA declarations allow it yes, HOA restrictions may impact common property but almost always are applied to the private property of owners...

Generally, if you do not own something, to sell something you do not own and use the funds without permission is theft.

Generally, If you can prove you lawfully possessed the pills, then they should not have a basis to forfeit.

You do not specify when you filed and were denied benefits, but generally you have to act within 20 days of a denial to file an appeal.
