Wrongful Death – My Experience with Matthew Benson Baggett

My experience with Matthew Benson Baggett was one of the worst professional experiences I have ever had with an attorney. I would not hire him again under any circumstances, and I would strongly caution anyone considering retaining him for a serious or high-value matter. This was not a small case.... The financial exposure involved millions of dollars, and I expected an attorney handling a matter of that magnitude to understand the applicable law, communicate consistently, develop a coherent strategy, protect the client’s interests, and remain engaged when the case became difficult. In my experience, that did not happen. I repeatedly had serious concerns about his handling and understanding of the legal issues involved. Important questions were not addressed with the level of analysis I expected, and I became increasingly concerned that the matter was not being handled with the competence, urgency, or attention the circumstances required. Communication was also extremely poor. Emails went unanswered. Telephone calls were not returned. Important issues remained unresolved while I waited for responses. At a time when the case required active representation and clear direction, communication deteriorated to the point that I felt completely abandoned by my own attorney. Ultimately, he stopped meaningfully handling the matter and moved on. From my perspective, he effectively dropped the case and then ghosted me when the situation became difficult. There was no level of accountability or client service remotely consistent with what I would expect from counsel entrusted with a multimillion-dollar dispute. What happened afterward was even more troubling. After having been involved with my side of the dispute and having been exposed to information relating to my position, he subsequently sought involvement with the opposing side. I found that sequence of events extraordinary and deeply concerning. It raised very serious questions for me regarding professional judgment, loyalty, confidentiality, conflicts, and ethical boundaries. I will not claim to know his private motive for doing so. What I can say is that the chronology was alarming: the representation deteriorated, communication stopped, he moved away from my matter, and he later attempted to become involved with the opposing side of the same dispute. For a former client, there are few things more disturbing than watching an attorney who previously had access to your matter later attempt to work with the people positioned against you. The consequences were not theoretical. This matter carried enormous financial stakes, and I believe the way my representation was handled materially harmed my position and contributed to consequences measured in the millions of dollars. Clients hire lawyers because they need someone who understands the law, responds when the client calls, remains engaged when litigation becomes difficult, protects confidential information, recognizes potential conflicts, and treats the client’s interests as the priority. Based on my personal experience, I did not receive that standard of representation. This was not a minor communication problem. It was not simply a disagreement about litigation strategy. In my experience, it was a complete breakdown in communication, legal judgment, responsiveness, accountability, confidence, and trust. I would never retain Matthew Benson Baggett again. If you are considering hiring him for litigation, particularly a matter involving substantial financial exposure, I strongly recommend conducting extensive due diligence. Ask detailed questions about communication, case management, conflicts, withdrawal from representation, and what happens when a case becomes difficult before entrusting him with anything important. I wish I had done more due diligence before placing such an important matter in his hands.
