Issue: Whether a developer's affirmative defenses to a quiet title action bar a claim of adverse possession for land within the developer's preliminary plat of a subdivision. I argued the case and the ... Court held, "Because resolution of a claim for adverse possession is not within the scope of the statutory definition of a "land use decision" and there is no basis of equitable estoppel here, we affirm."

Washington State Court of Appeals: The Estate of Devereaux vs. Cutter

OUTCOME: My client, Estate of Devereaux prevailed.

Civil procedure matter. Issues included whether Washington State law required CR 6 standard for "Three Day Notice To Pay Or Quit", whether the trial court matter was moot, as the Plaintiff had the Def ... endant evicted from the property via a second unlawful detainer petition, and whether the Plaintiff was entitled to attorney fees. The Supreme Court held that a CR 6 standard was not required for Three Day Notices, the Court of Appeals held the matter was not moot and the Court of Appeals held the Plaintiff was entitled to reasonable attorney fees and costs.
