OUTCOME: Defense Verdict

Rear end car accident. Our client admitted negligence in the accident and the trial was for damages only. The Plaintiff had an accident reconstruction expert that stated the impact speed was 40 mph. ... We presented photographs and our own expert who showed the accident was a low speed accident and impact occurring at less than 10 mph. The Plaintiff had pre-existing back issues and the jury returned a defense verdict on behalf of our client; concluding the accident did not cause Plaintiff's injuries. We filed post trial motions for attorneys' fees and costs as the prevailing party and pursuant to a proposal for settlement. We ultimately obtained a verdict against the Plaintiff in the amount of $102,438.69 for attorneys' fees and costs on November 5, 2015.
