Former same sex couple owned real property together. We filed to partition real property and the case ended up in family court because there was a pending SAPCR regarding a child of the relationship. O ... pposing counsel tried to argue that the court should create new law and make a ruling about the house based on the best interest of the child. We argued that my client's right to partition was absolute, that the parties were not married, and that the Court could not create new law and was bound to order the partition of the property and either order the other party to buy my client out or order the house sold and the proceeds divided.
