Nicholas Ryan Nesmith

I first began communicating with Mr. Nicolas on October 17, 2025, regarding legal representation in a criminal case. Over the course of more than two weeks, we exchanged numerous text messages to arrange phone meetings and discuss payment for legal services. Despite my repeated efforts to confirm app...ointments and obtain updates, Mr. Nicolas’s responses were frequently delayed, inconsistent, and filled with excuses about technical or phone issues. After multiple follow-ups, I ultimately sent a $3,500 retainer payment via Zelle to his business account “Nesmith Law” on October 31, 2025, as partial payment toward the representation. However, at no point prior to payment did I receive a written retainer agreement or contract. When I requested one several times, I was told it was “being worked on.” Following payment, communication continued to be unreliable. Mr. Nicolas failed to confirm progress on the case, provide documentation of work performed, or show proof that he had filed any entry of appearance with the court. I later confirmed that no motion or filing listing him as counsel of record was ever submitted. On November 2, 2025, after weeks of poor communication and no evidence of legitimate legal work, I informed him in writing that I was terminating our working relationship and requested a refund of my retainer. Mr. Nicolas eventually returned a portion of the funds but failed to refund the remaining $500, despite acknowledging receipt of the full payment and agreeing to return my deposit.
