WC Defense Attorney since 1988, focusing on working with Employers to keep them out of litigation, properly handle their claims when they do arise and assist the Employer and Employee with solid, viable return to work strategies. When litigation does arise, I want my clients to be properly prepared, so that litigation outcomes are more favorable to the position advanced by the Employer/Insurer. We understand that while the Worker's Compensation system is supposed to be fair and impartial, it doesn't always seem that way to employers or insurers. We recognize that Employer conduct must be beyond reproach and work with our clients on strategies to properly position and clearly illustrate the propriety and veracity of every move they make.
An integral part of this strategy requires a thorough understanding on our part of the client's situation, the personalities involved as well as the business necessity involved in personnel decisions and their worker's compensation implications. Training for Employers is essential to understand their obligations to their injured workers, how perceptions of injured workers and co-employees need to be properly understood and managed so that business necessity is not misperceived as callous, unfair or retaliatory. Training for Insurers to assist them in good and clear communications with their Insured Employers as well as creative strategies to bring claims to a conclusion works to the benefit of the Insurer's bottom line and to the Employer's modification rating and premium.
