OUTCOME: Medel's Story Played a Part in Padilla v. Kentucky

On April 9, 2009, a Writ of Mandamus was filed on behalf of Mr. Martin Medel in Cobb County (later amended to a Habeas which was filed on June 15, 2009). Mr. Medel's story of injustice was written in ... the Amici Curaie Brief presented to the Supreme Court of the United States in Padilla v. Kentucky. The brief was written by the Asian American Justice Center, Mexican American Legal Defense and Educational Fund, and Other Immigrants' Rights Organizations. Although the Superior Court Judge of Cobb County did not grant Mr. Medel's habeas, the Supreme Court's ruling in favor of Padilla vindicated the injustice against him. Mr. Medel has been released from INS and is living happily with his family.

After thoroughly investigating the case, I was able to prove to the Court my client's innocence at a pretrial hearing by providing to the Court, through documentation and witnesses statements, the actu ... al facts and circumstances surrounding the incident. As a result, the Court dismissed the Aggravated Assault charge against DG.

At 10:00 am, evidence came to light showing that my client was innocent. The case was to be presented to the Grand Jury at 10:00 am. I ran from the office to the courthouse and was able to stop the c ... ase from being indicted. The charges against WS were subsequently dismissed.

OUTCOME: Acquitted on All Counts.

BR was charged with 2 counts of Murder, 2 counts of Felony Murder, 2 counts of Kidnapping with Bodily Injury, 2 counts of Aggravated Assault, and 2 counts of Possession of a Firearm During the Commissi ... on of a Felony. After cross-examining the State's main witness for two days, impeaching the medical examiner with the time of death, and showing the value of phone records after testimony that they were of no evidentiary value, Bruce Roberts was found Not Guilty on all counts. Potentially facing a double life sentence in prison, the Law Offices of L. David Wolfe was able to give BR a second chance at life.

WC was charged with his 2nd Possession of Cocaine with Intent to Distribute and looking at a mandatory 10 years in prison without parole. I was able to have the charge reduced to Possession of Cocaine ... and WC plead guilty to 5 years suspended.

OUTCOME: The court reversed the trial court's order.

Mr. Santos sought review of a Georgia trial court's denial of his motion to quash an indictment charging him with failure to register a new residence address as required under O.C.G.A. 42-1-12, Georgia ... 's sex offender registration law. While Mr. Santos had been living at a homeless shelter for several months and had registered his address there, when he was asked to leave the shelter, Mr. Santos had no street or route address and did not report a change in address. Mr. Santos claimed that the registration requirements of 42-1-12, violated the Due Process Clause of the United States and Georgia Constitutions on vagueness grounds. The court agreed and reversed the denial of Mr. Santos's motion to quash. Section 42-1-12(a)(1) specifically stated that homeless did not constitute an address; the term "address" was defined as the street or route address of a sexual offender's residence. Because the statute gave no objective standard or guidelines that would put homeless sex offenders without a street or route address on notice of what conduct was required of them, the court held § 42-1-12 unconstitutional as applied to those homeless sex offenders who, like Mr. Santos, did not have a street or route address. Homeless sex offenders who were able to provide a street or route address, such as the address of a shelter at which they were staying, were not exempt from the registration requirements.

OUTCOME: DW was not convicted of any felonies.

DW was charged with 7 felony counts (4 counts of burglary, criminal damage to property in the 2nd degree, possession of tools for the commission of a crime, and theft by taking). DW had been recidivis ... ed and was facing a maximum sentence of up to 100 years in prison. The State offered a plea deal of 20 years to serve without parole. DW was accused of breaking into 4 rooms at the Westin hotel and stealing a number of items (including a laptop which was the basis for the theft by taking charge). DW was seen walking out of the Westin with a duffle bag containing items matching the description of the stolen items. When DW was arrested, he was found with a screwdriver in his pocket which the State alleged was used to pry open the hotel room doors. In addition, there was videotape evidence that was unable to be introduced at trial. After one day of jury selection and one day of trial, the jury began their deliberations and did not end until 3 days later. When the verdict was read, Mr. Williams was found guilty of only the theft of the laptop. However, during the trial the State was unable to prove the value of the laptop and therefore DW was only convicted of a misdemeanor. The charges were disposed of as follows: Count 1 burglary - dead docket, Count 2 burglary - Not Guilty, Count 3 burglary - dead docket, Count 4 burglary - directed verdict, Count 5 criminal damage - nolle prosqui, and Count 6 possession of tools - dead docket.
