For years I represented banks and interested parties in litigation stemming from the bank failures of 2009 through 2014. Banks engaging in joint lending opportunities, called participation agreements, ... were at odds when it came to liquidation of assets and how to treat defaults on loans in the wake of the collapse of numerous small banks. I negotiated the separation of lenders under these agreements, disposing of collateral and severing participation relationships where lenders' priorities were in conflict. This involved numerous cases before the United States District Court and mediation efforts.
