Attorney Brian Tevis got her bo ... nd reinstated and she was released pending trial. Once the State provided discovery, Attorney Tevis told the DA he could not prove the case. While an acquaintance of the defendant was on camera using a stolen credit card, and his vehicle was on camera parked next to the car that was broken into, there was nothing linking his client to the crimes other than that the actual perpetrator of the crimes gave her a gift card for her birthday and she didn't know it was from stolen funds. The state offered the defendant 8 years of probation, but we refused and said we wanted a trial. Once the actual perpetrator was brought to Cobb county and pled guilty, the State gave up and dismissed the case against our client.

Police had an anonymous tip about the smell of someone smoking marijuana, they went straight to the backyard of the home - which is not allowed without a warrant or exigent circumstances - without tryi ... ng the front door or even knocking. After telling my client to come outside and then patting him down, they didn't find anything except money in his pocket. Police started to leave, but got a call from the drug unit that they wanted to search the house and to detain everyone in it. So police went back and did so, again without a warrant, and found a large quantity of meth amphetamine. Attorney Brian Tevis filed a motion to suppress illegally obtained evidence and argued the motion in court. The Judge agreed with him, suppressed all the illegally obtained evidence, and the State dismissed the case.

Client and his brother charged in Fulton County with Kidnapping, Aggravated Assault with a Deadly Weapon, possession of a firearm during the commission of a felony, and possession of a firearm by a con ... victed felon. Client and his brother confronted someone whom he thought stole appliances from a house he was remodeling. It led to a physical fight between the 3. The victim said that a gun was put in his mouth and he was forced to get into the car right as police pulled up. We obtained the body camera footage that showed the victim and his girlfriend were embellishing their stories. We also noted the details in the report that indicated our client may have punched someone, but was not the person ever holding a gun or using a gun. And while it looked to police like the "victim" was being kidnapped in their truck, he had actually agreed to take the client to where the stolen items were so it was not kidnapping. Finally, we got about 10 reference letters from members of the community and a police officer in Texas who had grown up with our client and spoke on his behalf. The DA took another look at the case based on our presentation of the case and agreed to reduce their offer from Life Without Parole (because of the kidnapping with bodily injury) to 5 years of probation on only aggravated assault.
