OUTCOME: CDL DUI (over the limit) Reduced
Connecticut CDL commercial truck driver delivering a load in Georgia was arrested and charged with DUI, 3 counts of disobeying a traffic control device, and obstructing an intersection. Our client drov ... e his tractor-trailer down a street posted for no tractor-trailers and became stuck on a railroad crossing. The arresting officer claimed to have scored him as 6/6 on HGN, 2/8 on the "walk and turn" evaluation, 0/4 clues on the "one leg stand" evaluation. Our client blew a .053/.051 on the Intoxilyzer 5000EN (.04 is the pre se "limit" for commercial vehicles). Prior to trial we were able to demonstrate multiple errors made by the investigating officer during his investigation and problems with calibration of the Intoxilyzer. We negotiated a reduction to reckless driving and were able to enter the plea in Absentia; our client did not have to return to Georgia. 12D-07937-3
