Client had a DUI charge pending and his license was administratively suspended (see 2012D-05587-3) when he was arrested for a second DUI, driving on a suspended license, suspended registration, no insu ... rance, open container and he was also charged with loitering and prowling when he walked away from his car and the stopping officer. After negotiating a reduction to reckless driving on the first DUI and getting the client's driver's license reinstated, we negotiated a reduction on the second DUI arrest. Client plead guilty to reckless driving and nolo to driving on a suspended license. All other counts were dismissed. 2013D-01655-2

OUTCOME: 3rd DUI Arrest Reduced to Reckless Driving

Driver was arrested at her home and charged with DUI and failure to report an accident. Driver admitted to drinking a glass of wine and driving home. Driver denied hitting another vehicle; the officer ... claimed to see paint transfer matching driver's car. Driver scored 6/6 on HGN and appeared impaired on video. Driver refused the preliminary breath test and the state test. We were able to show driver took Ambian after driving and went to sleep before officers arrived at her home. The state had difficulty establishing a time line of when the accident occurred and whether the driver consumed alcohol and/or medication before or after the accident. The damage to the other vehicle was less than $500 and the driver exchanged her information with the owner of the other vehicle prior to police arriving at her home. Based on the issues we were able to demonstrate, the state offered the case for a reduction even though this was driver's third DUI arrest. 2013D-01562-2

Motorcycle driver stopped for speeding, admitted to drinking, Driver was described by the officer as having bloodshot eyes and the strong odor of alcohol. On the field sobriety evaluations driver was s ... cored as having 6/6 on HGN, 2/8 on WAT and 0/4 on OLS. After arrest driver blew .100 and .103 on the Intoxilyzer 5000EN. We were able to show the prosecutor that the officer was not fair or reasonable in persuading driver to withdraw his refusal. (see State v. Rowell, 299 Ga. App. 238 [2009]). We were also able to show the officer improperly scored driver on the WAT and driver only exhibited one clue (one clue is not consistent with impairment). Facing the loss of the test result and with two of the three field sobriety evaluations indicating driver was not impaired, the state offered the case for a reduction and the DUI was dismissed.2013D-01475-2
