Client was arrested for DUI Less safe, Failure to Maintain Lane, Defective Tires and Possession of Firearm by a Convicted Felon. The Felony charge was made in error and dismissed after I met with the A...ssistant District Attorney and provided documentation that the charge was the result of the arresting officer's error (he misread a computer printout). The case was moved from Superior Court to State Court for prosecution of the DUI and traffic offenses. Our motion to suppress the refusal of the State breath test was granted (client did not refuse the test; the officer terminated the test without giving our client an opportunity to take the test). The evidence of the DUI included driving on two flat tires, weaving, several confessions by our client that he was DUI and a confession he had consumed 2 beers, 2 shots and a Percocet before driving. He had mumbled, slurred, confused speech on the ride to jail, but since the officer did not Mirandize him after arresting him for the firearms charge and, during the ride to jail, asked him what firearms he owns, the video and audio of the conversation was inadmissible at trial. We went to a jury trial on DUI, failure to maintain lane and driving with no headlights. The evidence included a description of the driver having bloodshot eyes, slurred speach flushed face and strong ...odor of alcohol. We were able to show the officer was mistaken when he claimed the driver's eyes were bloodshot and her face was flushed. Her speach was due to an existing speech issue and the odor of alcohol was from her passenger. The Jury acquited on DUI and failure to maintain lane. Our client paid a $200 fine for driving with no headlights and went home. 11D-04203-6
