OUTCOME: DUI NOT GUILTY

Charges were DUI Less Safe, speeding and failure to maintain lane. The officer described our client has having bloodshot, glassy, watery eyes, slurred, mumbled speech, staggered, unsteady walk and lean ... ed against his vehicle for support. The officer also described our client as fumbling with his license and being confused, argumentative, defensive, insulting, arrogant and using profanity. The officer testified that, in response to being told he was stopped for speeding and failure to maintain lane, our client said, "I'm not drunk..." After a one day jury trial, the jury aquitted on the DUI and speeding charges and found our client guilty of failure to maintain lane. He paid a $200 fine and went home to his wife. 12C-43046

Arby's employee called 911 to report a suspected DUI and then delayed the order to give the officer ... time to get there. the office followed Defendant out of the Arbys and alledeged Defendant was speeding 55/45 and swerving and crossing the fog line and center line multiple times. The officer described Defendant as unsteady, staggering and slow in his exit and walk, bloodshot, glazed eyes, slurred speech and strong odor of alcohol. OUTCOME: DUI Reduced In Absentia for Out of State Client

An out of state driver in Georgia on business pulled out of a Taco Mac and into oncoming traffic, he realized his mistake and drove over a curbed median to get into the correct lane, all in front of a ... Suwanee DUI Task Force Officer. The driver was stopped and the officer noted that the driver’s eyes were bloodshot, his speech was slurred and he had a strong odor of alcohol. The Driver failed the field sobriety evaluations, and the officer claimed the driver admitted to drinking 5-6 beers in one hour. The officer arrested the driver for DUI, driving on the wrong side of road and failure to maintain lane. The driver refused the state breath test. He retained us and he did not have to return to Georgia to beat his DUI. We were able to terminate the “refusal” suspension at the ALS hearing and then negotiated a reduction to reckless driving on his behalf by showing the officer was “inaccurate” in his report. We then did a plea in absentia without our client having to return. All conditions of the plea can be completed in our client’s home state. The DUI, wrong side of road and failure to maintain lane were dismissed. 2011D-06767-1
