T.B. was arrested and charged with public disorderly conduct during Myrtle Beach Bike Week, because she cussed while talking to police officers. The officers broke her arm while carrying her to their ... patrol car. In spite of the trial judge's refusal to direct a verdict based on protected speech, or to charge First Amendment Law to the jury, a Georgetown County jury found T.B. not guilty at trial. T.B. has filed suit against the officers for wrongful arrest and assault and battery.

G.R. was charged with a chop shop violation in York County, an allegation that his motorcycle's VIN number had been altered or changed. What actually happened is that G.R.'s motorcycle was stolen by a ... SLED agent while G.R. was riding with Hells Angels at a toys for tots run. The SLED agent then tried to lean on G.R. to become an informant against the Hells Angels. G.R. refused and instead hired our office to recover his motorcycle. He was not charged with a crime until after we threatened to sue if the motorcycle was not returned. At trial, the judge directed a verdict of not guilty after two days of testimony, and following the trial the SLED agent personally returned G.R.'s motorcycle to him.

Despite the First Amendment implications of his arrest, the trial judge refused to consider the First Amendment or charge the jury on the First Amendment. The jury acquitted J.Z.
