On July 28, 2004, my life changed forever. Don’t worry it’s funny. All those years of getting shot at, fights, car chases, dealing with people who just didn’t like me because I was wearing a uniform, all those fears taught to me of how I could die, I WAS WALKING INTO A BUILDING, TRIPPED ON A CARPET, ...TRIED TO STAY UPRIGHT, AND BLEW OUT A DISC IN MY LOWER BACK. I would be alright. Fight. Been hurt before. Deal with it, come on back to work. First surgery in the fall of 2004, went from this hurts, to no one human can stand this much pain. Between these years I have had over 7 kidney stones for those of you who have had them. Before having to hire an attorney to get a second opinion on a second surgery, I was told you won’t be going back to law enforcement unless it’s a desk job carrying no weapon. Be lucky to wear a belt again. That sucks. Ok I will go do something else. Just fix the pain. Second surgery summer 2005, consist of screws and rods. Ok fight. Don’t tell me I can’t I will prove you wrong. Reality hit hard. The hell had not begun. In April 2007 I filed for Social Security Disability. Now if you’re reading this we have something in common. Your local office has you file and then 6 months later, tells you you’re DENIED. You have 60 days to appeal. I went with a guy who had worked with a friend of mine. Turned out well for him.. Look, I’ve been up against some of the best in my area in murder trials, D U I, you name it and I truly have respect for those guys. I have done my job and trust me, if I hadn’t they would have made me look like the fool on the stand. Some, if I ever get into trouble, I would beg to take me on as a client. The guy I chose failed to produce vital paperwork from two doctors at my hearing in 2009. Even the form you sign when you file for your Social Security giving them permission to get all your records didn’t have a copy of the reports. The funny part is when I looked on the evidence log before the hearing, they were not there. The only person at my hearing that had a copy of those reports, was me. After several months of waiting, I was denied. You have 60 days to appeal. Now the ship was going down. So the attorney decides to try and find someone other than him to handle my appeal. Two attorneys who dealt only with this type of appeal, denied him. Several people, those lawyers I mentioned earlier, who cared, gave me the name PAUL McCHESNEY. Right here in my area. I had never heard of him. Had a meeting. Talked for an hour. Asked if I could give him a day to read my file. Called me and said what a mess but I am willing to take you on. Two weeks later, sent me a copy of a 15 page appeal which had to be appealed through the appeals court in the State of Virginia. Back in the fight. Wasn’t alone anymore. What an idiot I was. Why didn’t I ask for help before? Live and learn. You know if you look in the phonebook you will find him in the yellow pages under attorneys. Yeah I hope someone reading this will call his office to start with. I’m going to try and post this on some sites. I finished this on March 29, 2015. THEY won my case in 2012. I waited to do this until this fight was over. The last paper signed. It took that long for the payment to the attorney to process, in my appeals case. Warning results may vary. THIS IS A FIGHT with Social Security. Find you a great, not good, attorney. Listen, the attorney is the captain of the ship. The staff they do all the finding of files, calling social security, and you will talk to them more than the attorney. Make sure you understand there is no magic wand to be waived, no half time, no time outs . Mistakes can’t be made or they cost you. Cost me a home due to foreclosure in 2009. Filed in 2007 with a guy. Won in 2012 with a real Social Security Attorney, Paul McChesney. GOOD LUCK. Keep fighting someone out there has it worse than you.
