Be careful! Will take your deposit and forward elsewere

I called and spoke to this lawyer on the phone before scheduling my consultation as he was recommended to me by someone else. I was told that he would be able to handle my case most definitely and that I would need to come in pay the $500 fee, speak with the lawyer and sign the contract. The day I we...nt in I paid the $500 upfront before he would even speak with me and then told him all my information. He told me he was my lawyer, had me fill out paper work and told me that he would begin working on my case. I left his office and about 1 hour later his assistant calls me to tell me that he is referring me to another lawyer and will not be representing me. I asked would I be getting the $500 back and she said no, why was I not told this before I paid this money? I cannot afford to just throw money out there for nothing! I would not recommend going to this lawyer

This misunderstanding is best explained with an e-mail I sent to this reviewer on May 10, 2018 (modified to protect confidences). The reviewer did not reply or accept my invitation to talk. [Reviewer], I’ve reviewed your AVVO review of me. I’m sorry you had a bad experience. However, you seem to have very badly misunderstood my initial role and the service I provided to you during our consultation. Honestly, if you haven’t had experience consulting with or engaging an attorney, I can fully appreciate how you could misunderstand. You called and spoke with Tyler Peacock (not me, but again, I can understand how you might confuse him with me) and described a dispute . . . and wanted to talk with an attorney. Tyler explained that I charge a $500 consultation fee and you asked for an appointment. As Tyler explained, the consultation fee is simply to pay for a short meeting, usually about an hour, to assess your needs and see what would make sense on a going-forward basis. Many people resolve all of their questions at an initial consultation. Some require further representation. During our consultation we discussed the dispute you had described to Tyler, but during that discussion it became clear that your most immediate need was for a probate and estate attorney. I am a litigator. I help my clients resolve disputes, such as the type of dispute about which you called. I’m not a probate or estate attorney, and I would not be able to help you with that particular issue. [Estate issues were] your most immediate need, so I went to my office, called a very respected probate and estate attorney, Nancy Norelli, discussed with her your circumstance and the urgency with which you needed her help, and asked if she could possibly see you right away while you were still close by (Nancy’s office is close to mine). She agreed (which was incredibly nice of her given the very short notice), and I asked my receptionist, Doris, to call you immediately, tell you that Ms. Norelli was waiting for you and give you the information you needed to get to her, all of which Doris did. Everything I’ve described here was part of our consultation for which you paid my consultation fee. There are some other things in your review that are not accurate and, again, I don’t think you mean to misrepresent what occurred, but rather just misremember or misunderstand. You did not pay a “deposit.” You paid my consultation fee, which is very different. I would not and I’m certain I did not tell you I was your lawyer for anything beyond our consultation; I did not have you fill out any paperwork (I think perhaps you’re thinking of the intake form and payment Doris took from you); and I am very certain I did not tell you I would begin working on your case. I’m certain of this because you had not engaged me for anything beyond our consultation, and in order to engage me you would have needed to review and sign an engagement agreement and I would probably have asked you to make a deposit to our trust account to secure payment of future fees (people sometimes call this a “retainer”). The first step was for you to deal [with estate issues], with Ms. Norelli or with other help. As to the dispute . . ., I would have been, and remain, happy to further discuss helping you. Again, I regret that you were dissatisfied and you are of course free to express your opinion about me. I’d ask, though, that you give some thought to what I’ve explained and consider withdrawing or revising your review. Some of what you’ve written is factually incorrect, so please at a minimum correct those misstatements. Last, I would have been happy to talk with you about your experience and I’m still happy to talk with you. Please feel free to just give me a call. Sincerely, Jared E. Gardner
