It likely means no bond has been set yet. Is he still in jail? After arrest the magistrate will often refuse to set a bond in a domestic case and...

The bank can sue whomever is on the loan. A family Court Judge can Order one party to pay the other. You should consult a local attorney.

You can sue in small claims court up to 5k.
