They usually don't. Each has the ability to sentence consecutively.

He can motion the court to proceed pro se, otherwise he must work with his attorney. There must be more to this than what you were told.

Yes if the person did not do it. While it is up to the prosecutor to prove guilt beyond a reasonable doubt, at trial, you can show your innocence...
