Ashley S. Rusher

Ashley practices in the areas of bankruptcy and commercial litigation, and chairs the firm’s Business Bankruptcy and Insolvency Practice Group.  She is an effective, results-driven advocate with 25 years of experience in counseling clients in matters of bankruptcy, insolvency and distressed debt.  Whether in bankruptcy court, state court, or around the workout table in forbearance negotiations, Ashley takes a very practical approach to meeting her client’s goals.  Ashley has represented clients in bankruptcy cases in Delaware, Florida, South Carolina, Georgia, Virginia, Arizona and Texas, as well as every federal district of North Carolina, and in state courts around North Carolina, including the following representative experiences:

·         Represent secured lenders in bankruptcy cases to recovery assets, protect the lender’s cash collateral, negotiate plan treatment, and maximize recovery on secured claims;

·         Represent unsecured creditors in bankruptcy cases as committee counsel or individual creditor counsel to maximize recovery on unsecured claims;

·        Represent secured lenders in receivership actions and state court liquidation proceedings including real estate foreclosures and personal property repossession or claim and delivery actions;

·         Represent secured lenders in out-of-court workouts, forbearances and modifications of lending relationships;

·         Represent business debtors in possession in chapter 11;

·         Represent parties to preference and fraudulent conveyance litigation in bankruptcy court including trustees, debtors in possession, liquidation trusts, trade creditors, and insiders;

·         Represent purchasers of assets in bankruptcy sales
