A Shining Star

Andy Fitzgerald is an old-school attorney in the most honorable sense of the word. He is brilliant, intense, focused, and methodically thought through the subtle nuances of my case. His heart was in the right place, and he truly cared that wrongs were righted and justice served. He called things as h...e saw them - even when it was uncomfortable - and was always my best advocate. Andy was referred to me by another attorney who had previously opposed him in court. I consider that the highest compliment. Andy will forever be my trusted counselor, and I could not recommend him more highly.

I paid $225 for a one-hour consultation with Mr. Fitzgerald about a breach of contract case, involving other issues, against a major corporation. The breach centered on a false accusation made by the corporation. I noted that it was a complicated case before meeting. The good: Mr. Fitzgerald ag...reed to see me on short notice. I was able to present documents to him and respond to his questions. We discussed in detail the accusation, which I vehemently denied. The bad: Mr. Fitzgerald told me that not only would he not take my case, but that “no reputable lawyer” would take my case. He said I had no chance of winning. He advised me to seek psychotherapy. I found his comments inappropriate. I continued my search and retained a highly reputable law firm. Based on their observations, I expect to win my lawsuit. The ugly: I emailed Mr. Fitzgerald to ask for a refund of $225. I requested the refund because I felt that he had acted in a highly unprofessional manner. For instance, his prediction about my inability to find a reputable lawyer and his recommendation that I enter into therapy seemed out-of-bounds for an attorney (I note that one of these statements has already proven false). The written reply I received from him to my refund request followed the same pattern of unprofessional behavior. He claimed, in writing, that I had admitted the accusations which the corporation had made against me. He repeated that I should go into psychotherapy: “I will admit fully that I had concerns about your relationship to reality.” The lawyer’s one-and-a-half page written reply contains other inappropriate and puzzling statements. He refused a refund. To summarize, this was an initial consultation with a lawyer whom I did not hire, but with whom I had continued contact, via email, due to my requesting a refund of the consultation fee. The lawyer’s behavior during our meeting, as well as his written response to my request for a refund, were extremely unprofessional. I am glad that I did not hire him and want to spare others that possible fate.

We are unable to speak about specifics regarding this consultation due to our duty of confidentiality, except insofar as this person has voluntarily aired details above. However, we disagree, completely, with the facts as presented by this person. This person did mention that we stated that we did not believe he had a meritorious case. We have a duty to the public only to prosecute cases that we believe are well grounded in fact and existing law, or that present a good faith basis for modification or extension of the law. We also have as a core principle a duty to clients and potential clients not to work on cases that we believe will ultimately result in a poor outcome for them, as we do not want to waste their resources either. Most clients and potential clients appreciate that about us. This person obviously took our negative evaluation of his case quite personally, when in fact we were giving our honest and best advice, and advice that we still believe was in his best interest.

Above and beyond...

Andy is a passionate and very intelligent litigator. He gave our case 100% of his focus and we couldn't have been happier with his work.
