Client and his wife were charged with pepper spraying and shooting protesters upset about a conservative speaking event being held on the University of Washington campus on the night of Trump inaugurat ... ion. The case involved dozens of witnesses and over 400 video clips. Client and his wife asserted their uses of force were lawful. Following a 6 weeks in trial and lengthy deliberations, the jury declared it would never reach a unanimous verdict. After a mistrial was declared, jurors told the lawyers that they not believe the state would ever be able to convict the defendants, and that justice did not require retrial.

OUTCOME: Dismissal recommendation reversed.

This case involved the first allegation of sexual misconduct litigated before the Title IX Panel (of the Faculty Review Board). The University concluded, after their initial investigation, that my cli ... ent committed misconduct by having sexual contact with a student that was incapacitated by alcohol. The University recommended dismissal as punishment. After I spearheaded a thorough investigation, assessed the new Title IX procedures for constitutional and legal issues, and conducted a two-day evidentiary hearing, the Title IX Panel revised many of its factual findings and reversed its recommendation that my client be dismissed. Instead of expulsion, my client was suspended for two quarters. He will then receive his diploma and move forward with his life.

My client was subpoenaed to testify before a grand jury investigating the May Day protests. He refused to testify and was incarcerated for contempt of court. After securing my client's freedom, I arg ... ued that the government was illegally withholding case records from the public, by holding them under seal. The 9th Circuit agreed and, in a published opinion, set forth standards for the sealing or release of records relating to grand jury investigations.

I secured hi ... s release, over the government's objection, after five months in custody. I demonstrated that further incarceration would be punitive instead of likely to compel the client to testify before the grand jury. Thus, his confinement was illegal.
