Troy Weaver slipped and fell on a KFC parking lot on chicken grease. The trial court granted a summary judgment based on the open and obvious doctrine. Although he said the chicken grease was white, ... the parking lot was black, "Anybody could have seen it," he testified he didn't see it. I felt that raised a fact issue but the court of appeals disagreed. Unfortunately, this is one of the leading case on the open and obvious doctrine. I have had it cited back to me on numerous slip and fall cases since then.
