Chris Hatch helped me with a very unusual situation. A will had been signed in the presence of 2 witnesses. However, the notary claimed that since she was not a medical doctor, she could not determine someone of sound mind, and therefore crossed out those words on the will. Depositions for the wit...nesses did not prove helpful, as they were employees of the same bank as the notary and were not permitted to answer questions dealing with sound mind on the deposition. As the will proceeded directly as it would under heirs at law, we petitioned to invalidate the will. Although this issue had not been seen by him or his firm before, (or other lawyers who approached us after court), and after navigating a few bumps along the way, we are happy with the result and have been able to move forward with estate administration as the deceased had wished all along.
