I got a dui2/21/2001,second one3/5/2006andrecently11/13/2009. Can they charge me for a felony,if the first one was over 8 years

I work in Virginia, where they can charge a Felony DWI if there are at least 2 prior convictions in the last 10 years. Other states don't even...
