Sold Down the River

Very poorly represented by Joel Katz for a Workmen's Comp case. Seemed to have a revolving door for lawyers handling injury cases. My file was buried in a drawer for a year or so until a consultant to the firm found it. They only want cases that are easy and a shoe in. I was exposed to chemicals... on the job. From day one I got nothing but negative feedback about my case. They wanted me to settle for almost nothing. If a firm doesn't know any medical experts for your particular injury you know you will not be properly represented. I was too sick from being sensitized to chemicals to fight them. Didn't settle and the case is still hanging. I have a new lawyer who has worked very hard to get my case heard. Workmen's Comp doesn't seem do their job any better than Joel Katz. My case was somehow dropped from their files when they switched to computers. How many requests does it take to get my case back in the data base? Very disappointed and poorly served by both the lawyer and Worker's Comp.

We here at the Law Office of Joel L. Katz, L.L.C. are very sorry that you were dissatisfied with our handling of your Worker’s Compensation Claim. We take each and every case we handle very seriously and always strive to provide each client with the best possible representation. Unfortunately, Maryland Worker’s Compensation law requires an injured worker (through his or her attorney) to prove a connection between a chemical exposure on the job and any health issues being alleged as a result of such exposure. Although we expended significant time and resources in your case, we were unable to secure a doctor/expert who was willing to provide the necessary medical opinion to prove causation between the chemical exposure and your claimed injuries. Without such supporting expert/medical opinion, we simply could not meet the legal requirements for proving your claim and we advised you accordingly. As a litigation firm, we never shy away from standing up for our clients or from battling insurance companies and we have handled many very difficult cases with very favorable results. Although we are sorry that you were dissatisfied with the outcome of your case, we as attorneys must rely upon the opinions of the medical experts in cases involving physical injuries. As part of our commitment and obligation to our clients, we are very upfront and honest with all of our clients in discussing both the strengths and weaknesses of their case and we make recommendations based upon our training and experience so that each client can make an informed decision as to whether to settle or go to trial. Unfortunately, we cannot address your complaints regarding the Maryland Worker’s Compensation Commission’s handling of your file as they are a state agency over which we have no control. As your case is apparently still ongoing, we wish you the best of luck in bringing such to a favorable conclusion.
