Inexperienced and Incompetent
This "lawyer" was horrible. Her selling point was that since she had previously worked as an insurance adjuster, that she had the insight needed to win cases. WRONG!!!! The first sign of her incompetence was when she sent me information about my case with the wrong date of incident along with a pleth...
We regret that this client did not get the money she wanted. This was such a hard case to win with many obstacles in liability and causation. Here, a hotel window fell on her head but she could not remember what room she was in, and the facility did not have that info either. She took video of the scene at the time of the incident on her phone, and then cracked and almost destroyed her phone, misplacing her own evidence. I personally spent hours trying to retrieve the video and was successful. Most lawyers would not take touch such a case on a contingency. She settled her case in Mediation. Ultimately we did everything possible to prove her case and help her, but even if we had proved causation, this individual had a large gap in medical treatments, sought a great deal of treatment for issues that were completely unrelated to her case, incurring thousands of dollars in unrelated bills that had to be paid. Often it is difficult for lay people to understand the legal process. Unfortunately this client did not understand the process no matter how often I tried to educate her. She did not understand that her acceptance of an offer for settlement is a legally binding contract that can be enforced in a court of law. There was absolutely no reprimand to either attorney from a judge or mediator. What this individual interpreted as a "mediator separating the two attorneys" was actually my request for a "caucus" which is a tool in Mediation procedure to help facilitate the process. Again, this layperson does not understand the process, and unfortunately never communicated her displeasure to our firm, so that we could address her concerns with her. She states she doesn't want to pay her attorney a dime because of her displeasure with our firm. She should ask herself, why then the Expert, the doctor, and the filing fees should not get paid? I have 20 years in the insurance industry, have my AIC and FCLS insurance designations, and have worked in claims for 15 of those years, I assure you, I did not ask my client what to do, I only gave her her options.
