Gave wrong information
Ms. Clothier represented us when we were adopting a child whose birth parents live in Md and we live out of state. The baby was born in De which required us to go to DE. get the baby and then stay in Md. until the adoption was approved. Ms. Clothier was able to get the paperwork quickly but that was the last thing she did for us which was good. On the 31 day we were told that the birth father wanted the baby back. We questioned the 31 days being that the law said the birth parent have 30 days to rescind the adoption. Ms. Clothier said that because the 30 day was on a Sunday, the birth father had the extra day. The next day, we went down to De. to give the baby to the father. This action was extremely hard but the lawyer, Ms. Clothier, had informed us we had no other alternative. After we gave the baby to the birth father and returned home, we waited a couple of days and the we started to investigate the 31 day statement. When we investigated the law, we could not find any reference to the 30 day exclusion. Still not satisfied, we contacted another lawyer who also could not find any reference to the 30 day exclusion. We were then informed by the second lawyer that had we not given the baby to the father, we had a case to keep the baby, but by relinquishing the baby, we gave up all rights to keep the baby. Ms. Clothier should have know that there is no 30 day exclusion and not have had us give up the baby.
