“A former client deposited funds into my escrow account to be used to save her home from foreclosure. 12 hours before the sale she retained bankruptcy counsel to stop the foreclosure. I issued a check for the court filing fee. Several months later the client filed a complaint against the bankruptcy attorney. Although she did not file a complaint against me, Bar Counsel reprimanded me for insufficiently documenting the disbursement. The Peer Review Board had determined no violation had occurred.”

“I was suspended for 6 months after making a misleading representation to a court in an effort to protect my client from prosecution for filing a false subpoena. Within 30 minutes of becoming aware of the subpoena, I had withdrawn it. There were no negative consequences to the opposing party in my client's litigation. A dissenting member of the DC Bar Grievance panel argued that a 30-day suspension would have been more appropriate under these circumstances.”
