Experienced attorney

My BMW was being driven southbound on Rockville Pike when a deer started to run across the road. The driver of my car stopped. But, the driver behind her didn't stop, and smashed into my BMW. The other driver (who didn't stop) has an insurance company named USAA. They agreed their driver was at f...ault. They made me take my car in to their shop, but eventually said it's not worth fixing. They offered to write a check to us, but it was much lower than I think the real value was. I refused the check, and got an appraisal for the value of my BMW (before accident). It was several thousand dollars higher. I took them to small claims court. But, I lost my case, and the Judge sided firmly with USAA, saying that I should have hired an attorney, and that USAA's offer doesn't prove anything. The judge even refused my request for a continuation. This is despite the fact that one was granted because their driver was on vacation and was needed as a witness. I opposed it on solid grounds. The motion itself noted it was opposed by me, yet it was decided against me even before my motion to oppose was needed to be mailed. And it was still granted. Worse, that driver didn't even show up to the trial! I contacted Marykay and she was kind enough to give a free consultation. She knew that judge well, although she said he was usually really reasonable. She demonstrates experience. Also, she was the least expensive attorney I was able to find on the avvo site that was willing to consider taking an appeal from small claims. We need more attorneys like Marykay and I'm thankful she's her to help people who feel that have been victimized. I'm also thankful for the avvo site allowing people to know of her. Jason

I will give marykay 5 out of 5 stars

I am still a client and I will have no problem with using marykay services she covered everything that was going to happen within the case for the custody battle and she won my case she covered all the grounds I had a very positive interactions with her and she gets the job done

We all Make Mistakes, Mine was Ms Canarte

This attorney represented me when I was an employee with Montgomery County Government when I was fired for being Handicapped. I wrote my final appeal and my firing was overturned. I signed an agreement when I went back to work for the When the county first attempted to fire me for being Handica...pped. They tried to say my Physical disability prevented me from doing my job, when the medical doctors stated in their report that my disability was due to injuries that occurred in the line of duty then the county then made new allegations that I was not working up to the standard expected of me as my reports were poorly written and I got lost constantly while traveling across the county which never happened and lacked the documentation And I was offered a job back with the County Government, I signed an agreement with the county that was suppose to put all the accusations made against me in the past as if they never happened. However when I went to retire on disability the county brought up all the previous allegations as if they were proven facts, which was in violation of our written agreement. When the county brought up these unfounded complaints from the years previous, Ms Canarte never made any attempt to dispute any of the county’s prior claims against my ability to do my work, and let them stand. The county said that I could not properly prepare my reports. But I had documentation and examples of my computer designed Reports that were prepared by computer that were grammatically correct and properly prepared in a timely fashion in contradictions to the counties claims. I tried to get Ms. Canarte to prepare for these issues but she refused to take the information and told me that the county would never these things up. I made the mistake of thinking that because Marykay Canarte was my attorney during my first case with the county that she would be a good person to represent me during my appeal with the county when I suffered my back injury as she was familiar with my case. However she seemed to have her own agenda in mind. When I was being questioned by the County Attorney I was thankful that one of the questions that I was afraid that she would ask, she didn’t ask, and to my great disappointment it was one of the first questions that Ms. Canarte asked me. I thought, God you must be one stupid person to ask me that question without knowing to answer to that question. I have learned that when a person suffers a back injury and is operated on, that there will almost always be other injuries that are sub-sequential to the primary injury and are unavoidable as future injuries are emanate. Although this point was made by my medical Doctor, it is one that she failed to bring out in her summation, Which could have been a winning point. When she was asked if she would like to go first or have the county’s attorney go first or would she like to go first she elected to go first, Letting the county attorney rebut everything she said. In the law courses that I taken I have always been told you always elect to go last when given a choice. She put my Medical doctor on the stand first so he was not available to rebut the County case later on. Ms. Canarte should place me on the stand first and then brought in our witnesses is to collaborate my testimony and then the doctor last in order to rebut to county’s case. Also there was a clear discrepancy in the last two medical appointments that occurred at the same time as I never went back to Kaiser after June 2003. I had an appointment for a back treatment at the Rockville Pain Center and on the same date and time I was suppose to be at Kaiser as my doctor was reading an x-ray in his office that was suppose to be mine, that wasn’t and that record still stands. I drove to Ms Canarte office in Montgomery County Md. And hired someone to make the trip with me and when I got there she refused to discuss anything with me. I point out to her that Kaiser had documented my file with a neck injury with X-rays shoeing a cracked vertebra, however there weren’t any supporting

No good deed goes unpunished. This client begged me to take his case. I worked my butt off and did a slamming job despite very bad odds. I had previously handled several prior matters for this client and he had bad mouthed several other attorneys before I took this case. Some people are just never happy or appreciative of a good thing. Consequently, they bring more negativity and unhappiness into their own lives.
