After leaving my position as an Assistant United States Attorney for the District of Columbia over twenty-seven years ago, I focused my legal practice on defending nursing home providers in malpractice lawsuits here in the D.C. area and across the country.  In doing so, I learned in great detail not only how those cases are prosecuted and defended, but also how plaintiff's counsel and providers evaluate them for settlement purposes.  My extensive experience in defending nursing home cases proved to be one of my strongest assets once I began representing plaintiffs in those cases, as I now routinely do.

My goal in litigating any case is to evaluate it as quickly as possible in order to determine whether it can be resolved early on in a manner that makes sense for both sides.  This approach promotes closure for all parties and reduces the often wasteful and unnecessary fees and costs involved in protracted litigation.  If early resolution of a case is not possible, I welcome the opportunity to try it to verdict before a jury or arbitration panel.  My most recent nursing home jury trial resulted in a satisfactory settlement for my client just prior to the closing arguments.  My most recent nursing home arbitration resulted in an award totally in my client's favor after opposing counsel steadfastly refused to engage in meaningful settlement discussions.      

Given my strong belief in the benefits of early dispute resolution, I have completed the arbitration and mediation training programs sponsored by the American Health Lawyer's Association ("AHLA").  I served as an arbitrator in a Florida nursing home dispute this past spring and look forward to doing so again this fall.

Before I went to law school, I worked as house painter, a laborer on gas pipelines and concrete crews, a carpenter, and a roughneck on an oil rig.  I believe that that  background, together with my educational and professional experience, has helped me to appreciate and relate to clients and jurors from all walks of life.

The Only Lawyer I Would Call
Recently, I was involved in a personal law suit and had the privilege of working with Mr. Kelly. Mr. Kelly was so easy to work with during this stressful time and he very quickly put me at ease every step of the way. I trusted Mr. Kelly quickly and was never disappointed in his ability to represent me. I know that Mr. Kelly had other clients while working with me, but he always made me feel as though I was his first priority and was responsive to my every question. His knowledge and expertise shown through as the case moved through the litigation process. Even as we faced a very adversarial opponent, Mr. Kelly maintained his professional manner while never backing down from the case. He always kept my needs as his priority. Made the best of a horrible situation
My mother eloped from as assisted living facility after a stay of 8 days. She was struck and killed by a car on a main road outside of their entrance. Through channels my sister found and contacted Brad Kelly. He was a godsend. Jumped on the case right away, gave us his full support, was always available for a conversation; and took us through the mediation process to a very successful conclusion. He was thorough and worked for a quick resolution. Before we found Brad we had hired another attorney who did nothing for 3 months. Within a week of contacting Brad he was actively pursuing the case.

The kind of person you’d pray to get! Oh! He’s a pretty good darn lawyer too!
My experience with Mr. Kelly was absolutely amazing! He was so kind, informative, civilized, and polite! He was courteous, and attentive! He listens without cutting you off! He was very easy to talk with! He was very generous with his time, and his advise! He knew early on that he wouldn’t be able to take my case, but only because my situation was not within his purview, but he is just so wonderful that he’d spent at least a half hour of his very valuable time with me, a total stranger on the phone, giving me all of his best advise! Legal Counsel Recovers Stolen Domain Names
Brad Kelly is our corporate counsel and handles a variety of issues on our behalf. Most recently he was instrumental in recovering our domain names, which had been personally renewed in his own name by one of our vendors. This vendor then offered to sell the names back to us at an exorbitant price, effectively holding them for ransom! The ransom demands were accompanied by threats against our staff. Mr. Kelly developed a step-by-step strategy that was designed to be cost effective for us, would shield our staff from further threats and would result in the return of our property. After just a few weeks of negotiation with the vendor, Brad notified us last week that the domain names would be transferred back to our account and that has now occurred. Losing control of these names might have resulted in considerable damage to our reputation, and we are grateful to Brad for his work on our behalf. We highly recommend Mr. Kelly to anyone needing legal advice related to the business of Long Term Care.

Nursing Home Plaintiff's Attorney Made them Pay !!!
Mr. Kelly was a 5 star Avvo pick. After we were BS'd by a plethora of "Nursing Home" Attorneys, he proved to be the most knowledgeable, most Aggressive, Best Tactician & Ultimately Shrewdest Counsel we could have retained. He also proved to be the most Ethical Lawyer of the 5 we interviewed, and despite being told by everyone else that our case was "only worth, maybe six figures" by the "Other Nursing Home Experts", Mr. Kelly, without even going to trial, settled for more than twice that number !!! We recently referred a friend who had been jerked around by three different "Nursing Home Experts" & Mr. Kelly settled his Case in 19 days! ( there were only 8 weeks left before trial when our friends "Nursing Home Expert" casually mentioned he would need $7,500 for an "Expert Witness". Then his "Nursing Home Expert" said he felt the settlement possibilities would be, if attainable, a fraction of what he had initially sued for... We gave him Brad Kelly's number Friday, he called Mr. Kelly on Monday, and 19 days later had a check that was close to the original amount asked for. !

Great experience!
Brad has been a blessing to me and my family. His vision and ability to look at a case from angles no other attorney could or thought to consider is why my family and I highly recommend him. Brad did not make us feel like “another case” but more like family, as if he was personally invested. We didn’t feel like a number like some of the most fancy law firms make you feel. Superb Legal Help!

Defense of several cases over the past 10 years for my D.C. nursing facility
Brad Kelly has led the defense of many legal issues for my nursing facility. I have found him aggressive (no stone is left unturned), knowledgable (he can work his way through a medical record), competent (he knows regulations and their application), spirited (he keeps us calm through his humor and demeanor) and to the point (respond to plaintiff's bar, avoids trial, mediation should always be used, but always in the best interests of my facility). More than we could have hoped for
From the moment I met Brad, he was open and honest and on top of our case even before we officially hired him. I had retained another attorney prior to Brad, who did nothing for our case for 3 months. I was given Brad's name by an old friend, and within two weeks of that initial call, Brad had our case built and ready to roll. He is extremely passionate about his work, which makes him extremely knowledgeable and caring about your case. I can't imagine a better outcome after the tragic loss of our mother at the hands of assisted living. We have been heard and Brad is largely to thank for that. You cannot go wrong with this man. He is open and forthright and will lay everything out on the table for you. It is comforting to know that the person that is defending you, is doing everything possible to get you everything you deserve and doing it at the minimal expense he can. You cannot go wrong with Brad. I am just sorry we lost 3 months with another firm, but am glad that it brought us to him. I really like him too, and that is a plus! A Lawyer who always has his client's best interest in mind
Brad is smart, creative, aggressive and sensible. He is pragmatic but also not afraid to push for truth and justice. Compromise is an artform and Brad certainly knows when and how to use it. His expertise in matters of long term care and government agencies interventions is well proven. I would hire Brad and his team again in a heartbeat.

LTC Insurance Defense - TPA relationship
I've known Brad for a little over 15 years. In this time, he has handled the LTC work for a large client of mine in the VA/DC/MD area. Brad, unlike many firms and attorneys, is not a 'billing mill' - he is well aware of budgets and cost savings and goes the extra mile to identify cases for early resolution without spending too much on discovery. He is well versed in the field and is well known by opposing counsel in the venue. I recommend Brad to anyone who required Med Mal insurance defense work. He works well both directly with clients, with TPA's and with other co-counsel situations. Basically - Brad knows his stuff and will save you money in the process.
