It does seem like you would be subject to the 10 year bar - have an immigration attorney go over your entire record.

For 50k do you meant EB5? EB1 is for extraordinary individuals and EB5 is for investments of $500k or $1 milion

She can file both as long as you are over 21. AP can take 60 to 90 days so I would say file the applications ASAP.
