OUTCOME: Case will proceed in the Ninth Circuit
In a challenge to an EPA waiver of federal preemption for California vehicular standards, we prevailed in establishing venue in the Ninth Circuit (California) rather than the DC Circuit (DC).
OUTCOME: Cert. was denied, but Justice Alito wrote a statement respecting the denial of cert.
I joined this case at the Supreme Court phase to petition for a writ of certiorari to challenge the approval of a class-action settlement; this was a pro bono case for me to assist the Center for Class ... Action Fairness.
OUTCOME: Court favorably addressed our conflict-preemption issue
My clients participated as amici curiae and raised issues of conflict preemption that the parties did not raise. The Supreme Court's decision addressed the conflict-preemption issue that we raised, and ... the Ninth Circuit on remand expanded on them. (We also participated as amici curiae in the remand.)
