On October 23, 2009, an explosion and fire occurred at the Terminal of Caribbean Petroleum Corporation (“CPC”), near San Juan, Puerto Rico (“the Terminal” or “the Facility”). The resulting explosion wa ... s measured as the equivalent to a 2.8-magnitude earthquake on the Richter scale. Id. The tanks exploded at approximately 12:23 a.m. and could be heard over five miles away and shook windows and doors over two miles away. At some point the flames reached a height of 100 feet (30 m) above the refinery and in total destroyed approximately 20 holding tanks. Id. The initial fire destroyed eleven storage tanks at the Facility, but quickly spread to other tanks. The tanks contained gasoline, jet fuel and fuel oil, including virtually all of the fuels which originated with AOT Limited (“AOT”). Over 240 FBI and other investigators analyzed the explosion and did not find evidence that it was intentional. Authorities are still investigating the cause of the explosion and fire, and to date no final conclusion has been made, and no official report has been issued.
