Husband dies and wife is later sued by a company who buys up credit card debt Midland Finance. We appear for a Jury trial and the Judge says this is the first time he will be having a jury trial on a ... credit card case. I then reminded the Judge I had filed an Objection to Business Records Affidavit. We argued the matter and after the Judge had agreed on most of my request, regarding testimony in the affidavit, I asked if there was a copy of a written pre-suit demand in what had been filed with the Court. He said there was not. I then moved that this letter not be admissible. The Judge agreed and I moved for verdict for defendant as Plaintiff couldn't prove their case without such demand, which he granted. Opposing Counsel didn't know what hit him.
OUTCOME: Case dismissed and because we showed the Officer lied on the police report regarding what led him to enter the shop, and pointed to other discrepancies in other cases, the Officer is no longer employed as a peace officer.
Officers obtained a warrant for a residence based upon a snitch. However, in addition to searching the residence the Officers went to a shop next to the residence where the owner of the residence work ... ed. The problem was it had a separate legal address. So, when they entered and seized my client at gunpoint, this exceeded the scope of the warrant.
OUTCOME: Dismissal

We showed how easy it would have been for a nonhandcuffed person to have put the small corner with meth down the air conditioning vent, up under the dash, deep down in the seat, in the window seal, eat it, almost anywhere, but under the seat he is sitting in. We also showed how even though the officer said they clean out and search their vehicle after every shift, they could miss something. We played the game of "what if". What if the person arrested the night before stuck this in the springs under the seat, the getting in and out could have made it fall out.
