Father prevailed in trial court in a child custody case in Montgomery County, Tennessee. At trial, Father argued for a change of custody on two primary factors: 1) the Mother moved away to Texas witho ... ut providing notice to Father, and 2) Mother had an unstable lifestyle which was detrimental to the child. Conversely, Mother argued that she should remain the primary residential parent because the 1) Father was moving to Germany for military duties, 2) the child preferred to stay with mother, and 3) the child had a network of friends in Texas and was doing well in school. The trial court granted custody to Father, finding that Mother's clandestine move to Texas and instability warranted a change in custody. Mother appealed and the Court of Appeals completely affirmed the trial court's decision.
