Alleged Commingling of funds
Aug 14, 2013OUTCOME: The Court found the funds were not commingled to the point of being unidentifiable as sole and separate funds and the Court cited in its ruling the exact case law I cited on behalf of my client in my client's Pre-trial Statement.
The opposing party alleged my client had commingled several hundred thousand dollars of his father's money with community funds and therefore the funds were commingled to the point of becoming communit ... y property. My client with the assistance of an expert witness was able to present persuasive testimony that the funds were not commingled to the point of being unable to identify what was sole and separate and what was community. This resulted in a ruling completely in my client's favor.
