The jury returned verdicts against the defendants for Legal Malpractice, Insurance Agent Negligence, Intentional Misrepresentation, Breach of Fiduciary Duty, and Civil Conspiracy. The verdict included $100,000 in non-economic damages in a legal malpractice case. The verdict was the culmination of two years of litigation against five defendants with multiple defense lawyers. It was vindication for our clients, with the jury returning a unanimous verdict on every count, and 100% of the damages requested by William Eadie in closing argument. The result exemplifies the Spangenberg Law Firm’s dedication to each client when the claims and damages are difficult to explain. The issues included formation of an attorney-client relationship without having met or signed a contract with an attorney, the Medicaid application and payment process, and discretionary trust law, with four experts, six lay witnesses, and over a hundred exhibits. Despite the complexity of the case, the jury returned their verdict in just over two hours, including their lunch break, after a week-long trial. The trial included presentation of an out-of-state witness live via video conference, which required setting up a video conference system in the Old Courthouse. Besides lowering expenses compared to taking a video deposition, it also allowed for a more engaging trial presentation for the jury. Our attorneys were able to present dozens of pieces of evidence electronically for the jury during the trial and closing argument using the latest technology, from the trial table. Two of the defendants settled during deliberations for a confidential amount, although the jury was allowed to continue deliberating and found against all defendants.
