The solution to this problem is to get a criminal defense attorney to help keep tem out of jail. Then they will need a good immigration attorney...
Will the Civil Surgeon/USCIS be able to access my medical records to see this? Do I have to tell them about this?

No the civil surgeon will not be able to access the records. You must answer the questions truthfully when you apply to immigration for anything. ...

Absolutely correct because India is not on the approved country list for those visas.

If your change of status is denied you are still an H-4 as long as your spouse or parent is still on H-1B. Start the process now for the F-1.

Yes your H-4 was changed when you were approved for the H1B.
