Her US Citizen son filed an I-130 visa petition on her behalf and USCIS issued an Request for Evidence demanding that the ... applicant obtain and provide a birth certificate from Jordan. She had not resided there for over 50 years and had no family there. I hired a lawyer in Jordan to get a no-registration certification and provided a United Nations report which described how Jordan did not require birth registrations in the 1940s. USCIS accepted the response and moved forward processing the case.

This is a case where the immigration judge denied a 245(i) case for Indian nationals who presented sufficient evidence of their physical presence ... in the United States on and after December 20, 2000. The Judge held that they failed to comply with the regulation under INA 245(i) because they did not present government records, W2s and other documents that are typically unavailable to persons without a social security number. I argued the case in the Second Circuit after the government attorneys refused to settle. The Second Circuit overturned the denial and sent the case back to the Immigration Judge, who was forced to approve it. The clients got their green cards.
