The seller under a land installment contract filed a complaint in ejectment in the Court of Common Pleas against the buyers. The buyer-defendant filed preliminary objections based on Hohmann v. Webb, ... arguing that the Plaintiff had failed to file a complaint in mortgage foreclosure. The Durocher court revisited the Hohmann decision and overruled the preliminary objections.
