Richard Daniel Gable Jr

Richard D. Gable, Jr. is a Partner at Butler Pappas. Rich is a commercial litigator with a wealth of experience representing insurance carriers in property insurance disputes, including complex first-party coverage matters and claims of bad faith.  He also handles large loss commercial property subrogation matters, third-party insurance coverage disputes and environmental liability insurance claims.   In addition to insurers, Rich has experience defending other financial institutions from claims of fraud, unfair trade practices and violations of various other consumer protection statutes.  

Some of Rich's recent matters include the arbitration of a multi-million dollar dispute over Extra Expense coverage for a fire at a large manufacturing facility, the prosecution of a subrogation action arising out of a the catastrophic failure of a pre-engineered metal building and the defense of a commercial property insurer in the appraisal of a seven-figure property insurance claim.   He is often engaged to provide coverage and claims handling advice early in the claims adjustment process to avoid or eliminate costly litigation to his insurer clients.  Rich is a past Chair of the American Bar Association's Property Insurance Law Committee and was recently recognized as a Pennsylvania Super Lawyer in the area of Insurance Coverage.

Rich received a Bachelor of Science in Commerce from the University of Virginia and graduated from the Villanova University School of Law. Following law school, Rich served as Captain in the U.S. Army Judge Advocate General's Corps where he tried numerous felony courts-martial as both a military prosecutor and criminal defense attorney. While in the Army he also served as a Special Assistant United States Attorney in the office of the United States Attorney for the Eastern District of Virginia. 

Rich is admitted to the state bars of New Jersey and Pennsylvania; the Federal District of New Jersey; the Eastern, Middle and Western Districts of Pennsylvania and the Third Circuit Court of Appeals. He has also been admitted to practice pro hac vice in many other states including Maryland, Virginia and New York.    

Some of Rich's other notable matters include the successful defense of a Fortune 100 insurance carrier against a seven-figure property insurance claim for water damage caused by storm water runoff from heavy rains.  In its decision, the court enforced the policy's anti-concurrent causation language preceding the flood and surface water exclusions under New Jersey law and dismissed as irrelevant plaintiff's argument that the damage resulted from sewer or drain backup.  Rich also defended a builders risk insurer from a multi-million dollar suit for property damage and soft costs arising out of the flooding of a construction site in Maryland and obtained a jury verdict in New Jersey Superior Court in favor of his property insurer client against a bad faith claim arising from the flooding of a manufacturing facility.

Rich is a frequent author and speaker in the area of property insurance and property insurance litigation.  Some of his publications include "Don't Leave Money on the Table: Pursuing Recovery for Large Uninsured Losses," The Metropolitan Corporate Counsel, June 2011; Chapter 7 ("Experts") and Section 11.09 ("Damages") of the Property Insurance Litigator's Handbook, American Bar Association, 2007.
