My decision to accept a case is based on a multitude of factors. When a claimant elects a limited tort policy, he/she is limited in his/her ability to sue and recover non-economic damages, i.e. pain and suffering. I evaluate each case to determine if an exception to limited tort applies or if the injury is serious and will overcome the legal threshold which requires proof of "a serious impairment of bodily function." After an accident, it usually takes months to determine if an injury will fully heal or remain permanent.
