Represented an company in response to a Notice of Intent to Revoke (NOIR) after the U.S. Embassy returned the petition on the basis of fraud as determined by New Delhi’s Fraud Prevention Unit and Kentu...cky Consular Center Fraud Prevention Unit (KCCFPU). Explained that both parties were correct and that no fraud occurred. NOIR cancelled and petition approved.

EB-2 Advanced Degree RFE

Represented a corporation in an immigrant visa classification (member of the professions holding an advanced degree) for the position of “Computer System Specialist.” A Request for Evidence (RFE) was ...issued on the basis that Form ETA 9089 indicated the following: 1) a master’s degree in “Computer Science, Information Systems, Telecom engineering or equivalent field…” is required for the position; and 2) a bachelor’s degree in the same field is required. The evidence submitted included a copy of beneficiary’s bachelor’s degree in “Astronautical Engineering.” U.S. Citizenship and Immigration Services alleged that this degree did not appear to be the equivalent of a bachelor’s degree in “Computer Science, Information Systems, Telecom engineering or equivalent field” and requested that additional evidence “must be in the form of an official record from the institution showing the dates of attendance, area of study, and date of degree awarded.”
Several experts declined to provide an equivalency evaluation and the University declined to provide any additional documentation to assist in the matter. The RFE response provided evidence that: 1) Electrical Engineering fell within scope of “equivalent field”; 2) Astronautical Engineering was equivalent to a degree in Telecommunications Engineering; 3) the Knowledge, Skills, and Abilities obtained from an Astronautical Engineering degree encompass those for the proposed position and; 4) beneficiary’s bachelor’s degree in Astronautical Engineering was equivalent to Harvard’s bachelor’s degree in Electrical Engineering. To prove the latter, I went through each course on beneficiary’s transcript and downloaded the course descriptions. Submitted Harvard University’s School of Engineering Plan of Study and related course descriptions. Created a table that contained a side-by-side comparison of courses which demonstrated beneficiary obtained the equivalent of a Harvard-trained Electrical Engineer. Case was approved.
