At least one of the family was intoxicated and repeatedly jostled the security officers who eventually restrained him as a safety precaution. One of the female family members caused her brother to attempt to free the first member from restraints. A melee ensued.

OUTCOME: Confidential settlement after mediation

We represented employees of a national retail store that apprehended a shoplifter who physically resisted and caused the struggle to go through the store across the sidewalk and out into Main Street. ... The shoplifter died as a result of cocaine induced excited delirium while being restrained and before the emergency responders arrived on the scene. The case was widely reported by news media and was the subject of wide spread attention not only in Kansas City but nationally. The shoplifter had several children by different mothers and the family was represented by more than one attorney. The case was further complicated by the shoplifter's extensive arrest and conviction record for mostly drug related offenses. After extensive discovery, exhaustive investigation, medical and scientific testimony by expert witnesses for all the parties and after protracted mediation, the parties reached a settlement to the benefit of all.

There were multiple wills filed so that competing interests sought to have their wills admitted to probate at the expense of the others. We negotiated a settlement favorable to our clients which included the provision that the estate pay all taxes, expenses and attorney fees which significantly enhanced the value of the settlement to our clients.

OUTCOME: Favorable settlement of multi-million dollar estate

We were hired by the grandchildren of an elderly farmer who had been unduly influenced by his much younger housekeeper to write a will in her favor and exclude his family. Our clients' father predecea ... sed their grandfather and they were surprised to learn during the litigation that he was not the biological child of their grandfather. In an ancillary action, we proved that the deceased grandfather had equitably adopted the deceased father and, therefore, our clients were his grandchildren and heirs at law. We also established that a notary public falsely swore that legal documents were signed in her presence. As a result of our representation, the housekeeper's will was thrown out and our clients shared their grandfather's multi-million dollar estate with his two surviving sisters.
